Salman Khan Firing Case: HC Orders Removal Of Actor's Name From Plea Over Death Of Accused

Salman Khan has been making headlines after the firing incident, happened at his Mumbai residence, Galaxy in April. In a recent development, the Bombay High Court has made a ruling regarding a plea seeking a CBI investigation into the custodial death of Anuj Thapan, an accused in a firing incident near the actor's residence.
Reportedly, accused Anuj Thapan was found dead in a police lock-up on May 1, prompting his mother, Rita Devi, to file a petition seeking justice for her son's demise.
Justices Revati Mohite-Dere and Shyam Chandak, presiding over the case, directed Rita Devi to remove Salman Khan's name from the plea. "Delete his name. Petitioner seeks leave to amend the petition to delete the name of respondent 4 as there is no pleading against him and no relief sought against him," the court said.
The case dates back to April 14 when reportedly two gunmen fired outside Salman Khan's residence in Mumbai. The alleged shooters - Vicky Gupta and Sagar Pal - were later arrested from Gujarat. Anuj was arrested on April 26 from Punjab along with another person for allegedly supplying weapons to the shooters for firing at Khan's residence.
However, the police reported his death as suicide, a claim contested by Rita Devi on May 3, who alleged foul play and sought a CBI investigation into her son's demise, alleging that he was tortured by the police.
The High Court, while acknowledging Rita Devi's plea, questioned the necessity of Salman Khan's involvement in the case, stating that he was not a pertinent party in the petition. The court directed the CID to determine Salman Khan's relevance to their investigation.
The bench said, "What is the point of making a person who is supposed to be the victim a party respondent? We see no reason why respondent 4 should continue to be in this plea. He is not a necessary party."
Rita Devi's advocate told the court that the magistrate issued summons to the petitioner on May 10, directing her to appear before it to record her statement on May 23, but she received the summons only on May 24.
Furthermore, the court adjourned the matter for six weeks and instructed the magistrate to reissue a summons to Rita Devi for her statement recording.
The court said the magistrate shall issue fresh summons to the petitioner and ensure it is served prior in time so that she can appear. The high court posted the matter for further hearing after six weeks. (Inputs from PTI)
