Union Home Minister Amit Shah on Wednesday stated that the Supreme Court order granting Delhi CM Arvind Kejriwal interim bail in the Delhi excise policy case was "not a routine judgment". Speaking to news agency ANI, Shah said that a "lot of people in this country believe that special treatment has been given" to Kejriwal. "I believe this is not a routine judgement," he said.

The Supreme Court on Friday, May 10, granted interim bail to Kejriwal until June 1 in connection with the Delhi liquor policy scandal. The decision, delivered by Justices Sanjiv Khanna and Dipankar Datta came amidst a heated legal battle surrounding Kejriwal's alleged involvement in a money laundering case linked to the excise policy scam.
Kejriwal, who has been facing charges related to the scandal, has been ordered to surrender by June 2. His lawyer, Abhishek Singhvi, had sought an extension until June 5, citing the upcoming vote count on June 4. However, the court rejected this request, underscoring the urgency of the situation.
The Delhi Chief Minister, currently detained in Tihar jail, was arrested by the Enforcement Directorate on March 21 in connection with the alleged scam. The ED, opposing Kejriwal's bail plea, expressed concerns about setting a precedent by granting bail for campaigning purposes. They argued against his release, citing his active involvement in campaigning for the Lok Sabha polls.
Highlighting that campaigning does not hold any special legal status, the ED submitted an affidavit opposing bail, emphasizing that no political leader had previously been granted bail specifically for campaign activities. Solicitor General Tushar Mehta guided the preparation of this affidavit, stressing the potential implications of granting bail for campaign-related purposes.
The ED's argument cautioned against the possibility of similar requests from professionals belonging to various sectors, leveraging their vocations as excuses for bail. The affidavit pointed out that granting bail solely for campaigning could set a problematic precedent, potentially impacting future legal proceedings.

The AAP, in response to Amit Shah's statement, spoke of the BJP's "real mission to bulldoze the Constitution".
"It is shocking that Amit Shah is openly challenging the wisdom of the Supreme Court. In the past too, the BJP government under Modi-Shah has overturned several decisions of the Supreme Court like in case of appointment of Election Commissioners, control of Delhi govt etc. just because they were not in their favour. This proves that BJP’s real mission is to bulldoze the Constitution of India and establish a dictatorship."
