'Lies': AAP Hits Back After ED's 'Kickback Charge' As It Opposes Arvind Kejriwal's Plea

New Delhi: The Aam Aadmi Party (AAP) on Monday hit back at the Enforcement Directorate (ED) after the probe agency opposed Arvind Kejriwal's plea challenging his arrest in the Delhi High Court. The AAP alleged that the probe agency was lying.
The Kejriwal-led party said that the Supreme Court did not find a money trail in connection with the Delhi liquor excise policy case. It added that the ED could not provide any evidence in the top court.
Hitting out at the ED, the AAP said that the federal agency is working at the behest of the ruling Bharatiya Janata Party 9BJP). It further alleged that the saffron party is trying to topple the Delhi government and even wants to stop Kejriwal from campaigning in the upcoming Lok Sabha polls.
The AAP's response came moments after the ED filed its reply to Delhi Chief Minister Arvind Kejriwal's plea challenging his arrest and custody in connection with the Excise Policy case.
ED's Reply In Delhi High Court:
In its reply filed before the Delhi High Court, the ED said Kejriwal's arrest was carried out in strict adherence to laws and added that the Delhi CM had "waived his right to question his custody as of today and the petitioner cannot now be allowed to argue that his custody as on today is illegal".
The ED maintained that "all procedural requirements of Section 16 of the Prevention of Money Laundering Act (PMLA), and Article 22 of the Constitution had been strictly complied with" when it came to his arrest.
The ED relied on the CM's submissions before the trial court where he said that he had no objection to his custody being extended, to state that the "petitioner has waived his right to question his custody".
"Arvind Kejriwal, Chief Minister of NCT of Delhi is the kingpin and key conspirator of the Delhi Excise Scam in collusion with Ministers of Delhi Govt, AAP leaders and other persons. Sh Arvind Kejriwal was involved in the conspiracy of formulation of the Excise policy 2021-22 to favour certain persons and also involved in demanding kickbacks from the liquor business in exchange for favours granted in the said policy," the ED stated.
The probe agency alleged that the proceeds of the crime in the liquor excise policy case were used in the Goa assembly polls in 2022 by the AAP. "Aam Aadmi Party is headed by Sh Arvind Kejriwal (National Convenor) and functions through the members of the National Executive Committee and Political Affairs Committee such as Sh Manish Sisodia and Sh Arvind Kejriwal, Sh Sanjay Singh and other members of the Party. As per the investigation done so far, the proceeds of crime of about Rs. 45 Cr approx. which was part of the bribes received for South Group was used in the election campaign of AAP in GOA in 2021-22," it added.
The proof agency stated that Kejriwal was directly involved in the formulation of the Excise Policy 2021-22. It further called that Vijay Nair is a close aide of Kejriwal. "Vijay Nair, who had no role/position in the Delhi Excise Department or in Delhi Govt, in fact acted as a broker/liaison/middleman on behalf of the top leaders of the AAP (specially Arvind Kejriwal) for getting bribes/kickbacks from various stakeholders in the Delhi Liquor business in exchange of favourable outcomes (policy changes) in the Excise Policy of 2021-22, which was being drafted at that time," the probe agency said.
The matter is listed for the next hearing on Wednesday, April 3.
Kejriwal was arrested on March 21 by the ED in connection with a Delhi liquor scam case. He has been sent to judicial custody in Tihar jail till April 15.
The ED has referred to Kejriwal as the "kingpin" of the Delhi liquor policy scam, which also led to the arrests of two AAP leaders, Manish Sisodia and Sanjay Singh.
Sanjay Singh gets bail
Sanjay Singh was granted bail on Tuesday by the Supreme Court after the ED conceded that it did not oppose the grant of bail to the AAP leader.
The AAP called it a victory of truth. "Truth always wins," said Delhi minister Atishi at a press conference. "AAP leaders were jailed over baseless accusations. The ED remained silent on the money trail and failed to recover even a single penny. Their arrests were solely based on testimonies from accomplices," she added.
