Supreme Court On Friday Refused To Stay ASI Survey Of Madhya Pradesh's Bhojshala Complex, Located In Dhar.

Bhopal: The Archaeological Survey of India (ASI) continued the survey of the controversial Bhojshala/Kamal Maula Mosque complex in Madhya Pradesh's Dhar district for the third day on Sunday.
The Kamal Maula Mosque Welfare Society President Abdul Samad, one of the parties in the court, told reporters that he has submitted some of his objections to the ASI via e-mail on Saturday.
"Our objection is that the ASI should not include in the survey the objects put up inside Bhojshala after 2003. I have sent my objections through e-mail," he said.
Samad said three ASI teams were working inside the complex. "I am the only person from the (mosque welfare) society who is inside during the survey. My objection is that the ASI team should work at one place and not at three places," he said.
Why ASI Is Surveying The Disputed Bhojshala Complex In Madhya Pradesh?
For several decades, the ancient Bhojshala has been claimed by both Hindus as well as Muslims. The Bhojshala-Kamal Maula mosque is protected by ASI, which allows Hindus to pray here on Tuesdays and Basant Panchami. Muslims, on the other hand, are allowed to offer namaz here on Fridays. However, this arrangement became problematic when Basant Panchami fell on Fridays in 2006, 2013 and 2016.
An organisation called the Hindu Front for Justice, filed a PIL on May 2, 2022, against the ASI order which allowed the Hindus to pray on Tuesdays and Basant Panchami and Muslims to offer namaz on Fridays. In its PIL, the Hindu Front for Justice claimed, “Only the members of the Hindu community have a fundamental right under Article 25 of the Constitution of India to perform puja (prayers) and rituals at the place of Goddess Vagdevi/ Saraswati within the premises of ‘Saraswati Sadan’, commonly known as ‘Bhojshala’ situated in Dhar. The members of Muslim community have no right to use any portion of the aforesaid property for any religious purposes.”
Since the order, numerous petitions have been filed in the High Court regarding the matter.
In September last year, security had to be beefed up in the region after an idol of Waghdevi (Goddess Saraswati) was installed inside the ancient building. The police took action after they were informed about the development. Later, the idol was moved safely out of the religious site by the police and the local administration.

The Madhya Pradesh High Court’s order on Monday allowed permission to the ASI to conduct a survey of the religious site. In its ruling, the court said, “Complete scientific investigation, survey and excavation , through adoption of latest methods, techniques and modes of GPR-GPS survey of the site in question constituting the disputed Bhojshala Temple cum Kamal Maula Mosque complex, as also the entire 50m of peripheral ring area surrounding/constituting the circular periphery from the boundary of the complex be conducted.”
