A man from Saskatchewan, Canada, named Trevor Howitt, was sentenced to 39 months in prison in January 2023 for having a sexual encounter with a 15-year-old he met on Tinder. In May 2024, Howitt successfully shortened his release conditions following an appeal, provided that he abstains from online dating.
After his conviction for sexual interference, the Saskatoon Court of King’s Bench imposed several other restrictions on Howitt for three years after his release, apart from the prison sentence. It included restrictions from visiting places or events with anyone under 16, as well as using the internet, except for employment purposes. However, according to the Canadian news organisation CTV News, Howitt appealed for the lifting of the additional restrictions, arguing that they were “beyond what was reasonable to minimize the risk.”
In a recent hearing, the appeals court conceded that the restrictions were indeed broad, but instead completely slashing them, they shortened it by a year and made several modifications to them. Notably, Howitt had admitted to knowing that the girl was under the age of legal consent even though her Tinder profile said that she was 18. Howitt admitted that the girl told her she doesn't have a driving license and that she was still in school. He also admitted to being addicted to pornography and sex.
The revised conditions of Howitt's release were notified via a written appeal by Justice Jeffery Kalmakoff.
"Mr. Howitt committed an offence that involved intrusive sexual contact against a 15-year-old child whom he had just met through a dating app," Kalmakoff wrote in the appeal. "Although Mr. Howitt professed to having believed that the complainant was of age to consent to sexual activity, he took no positive steps to verify that belief, even though, as the trial judge found, there were many signs that should have prompted him to make inquiries.”
Kalmakoff argued that a blanket ban on internet use is impractical due to its everyday necessity, but acknowledged Tinder's inability to protect minors. The appeal court also prohibited Howitt from internet communication on social media, dating apps and accessing pornography. Existing restrictions on authority positions with minors remained, with a new ban near the victim's workplace or home.
